What is a retaliation claim?
A retaliation claim is a type of legal claim that an individual makes when they face adverse action or consequences from their employer or another individual as a result of making a whistleblowing complaint. In New Mexico, retaliation claims are protected under the Whistleblower Protection Act. This law prohibits employers from taking retaliatory action against employees or former employees who report misconduct, illegal activity, or other wrongdoing. Retaliation claims might include demotion, suspension, or termination from employment; a reduction in pay or benefits; or other forms of discrimination. In order to file a retaliation claim, an individual must have evidence of the retaliatory action taken against them and show that it was related to their whistleblowing activities. Individuals may also be eligible for monetary damages and other forms of compensation if their claim is successful. It is important to remember that the law protects whistleblowers from all types of retaliation, not just from their employer. Individuals can also file a retaliation claim if they experience any type of harm or disadvantage from another individual or organization for exposing criminal or unethical behavior.
