What is a retaliation claim?

A retaliation claim is a legal claim brought by an employee against an employer to protect the employee from being punished as a result of whistleblowing. In North Carolina, employees are protected from retaliation for reporting or participating in investigations of illegal activities. A whistleblower is protected from retaliation for exercising their right to report an employer for participating in activities that are illegal or dangerous. When an employee reports an employer’s activities to the proper authorities, they may be retaliated against, such as being demoted, having their hours cut, or even being fired. If this happens to an employee, they may file a claim of retaliation. This type of legal action is taken to protect the employee from future retaliation, to obtain compensation for the damages they experienced due to the retaliatory act, and/or to restore the employee’s reputation. In North Carolina, employees have a few options for filing a retaliation claim. They can contact their employer’s human resources department and file a complaint, file a claim with the North Carolina Department of Labor, or file a lawsuit. Each of these options should be explored carefully, as the outcome of a retaliation claim can have major financial and occupational repercussions.
