What damages can a whistleblower recover?

In the state of California, whistleblowers who have uncovered illegal activities can recover damages they have suffered due to reporting the unlawful activity. These damages include lost wages, benefits, attorney’s fees, emotional distress, and any healthcare costs associated with the whistleblower’s medical treatment. The California Whistleblower Protection Act protects whistleblowers who have reported illegal activities. The Act provides protection against any form of retaliation, including job termination, demotion, and harassment. It also provides for the recovery of lost wages and other damages. In addition, it protects against any kind of discrimination and requires employers to provide a safe and secure working environment to whistleblowers. Under California law, if an employer retaliates against the whistleblower, the employee can file a claim with the Department of Fair Employment and Housing. If the employee is successful, they may be awarded compensatory damages, punitive damages, and attorney’s fees. Additionally, the Court may also require the employer to reinstate the employee’s job with back-pay. If a whistleblower is successful in a claim for damages, they will be granted back-pay for all lost wages, benefits and other costs associated with their case. They may also be eligible for emotional distress damages, which is a compensation for any mental, emotional or psychological harm caused by their employer’s retaliation. These types of damages can be awarded in addition to the other damages mentioned above. Overall, whistleblowers in California are protected from retaliation if they have reported activities that are considered to be illegal and can recover damages for any wages, benefits, and costs associated with their case.
