What is the Anti-Discrimination/Anti-Retaliation law?

The Anti-Discrimination/Anti-Retaliation Law (Labor Code Section 1102.5) is a law in California that prohibits employers from discriminating against, or retaliating against, employees for engaging in any “lawful act” in furtherance of a whistleblower law. This includes helping to investigate, disclose, or oppose activities that are in violation of a law, rule, or regulation. The law also protects employees who report or participate in investigating violations of law. The Anti-Discrimination/Anti-Retaliation Law protects employees by providing a legal remedy if they are discriminated or retaliated against for engaging in activities protected by the whistleblower law. This means that if an employee is subjected to any form of discrimination or retaliation as a result of their engagement in whistleblower activities protected by the law, they may be entitled to damages for the harm suffered. The Anti-Discrimination/Anti-Retaliation Law also provides employees with a private right of action, meaning that they can bring a lawsuit against the employer in civil court for any discrimination or retaliation they may have suffered due to participating in a whistleblower activity. If successful, the employee can recover damages such as back pay, reinstatement, and attorney’s fees.
