What happens if I die without a will?

If you die without a will in the state of Maryland, it is known as “intestate.” This means that your assets will be distributed according to the intestacy laws set by the state. The laws of intestacy in Maryland determine who will receive the assets of the deceased person. Generally speaking, the share of the inheritance goes to the surviving spouse and children. If there is no surviving spouse or children, the assets will be distributed among other family members, such as siblings, parents, and grandparents. It is possible that if none of those relatives exist or if they can’t be located, the assets will ultimately go to the state. It is important to note that when you die without a will, the court will appoint an administrator to take care of any final affairs. This administrator will typically be a close relative or a financial institution. Therefore, dying without a will can become a lengthy and expensive process that could involve lengthy court appearances and/or lengthy probate proceedings. Additionally, without a will, there is no one to represent the interests of the deceased person in court, meaning that a family member will be left to make decisions on behalf of the deceased person without their wishes being considered. For these reasons, many people opt to create a will in order to ensure that their wishes are carried out after their death. This way, they can avoid the lengthy and expensive probate process that can occur when someone dies without a will.
