How do I change or revoke a living will?
In Tennessee, it is possible to change or revoke a living will in several ways. The most common way to change or revoke a living will is by executing an amendment or revocation of a living will. An amendment or revocation must be completely clear in its intent and must be in writing. Signature by two witnesses is required, and those witnesses cannot be related to the one making the amendment or revocation. In addition, the amendment must be clearly identified as revoking or changing the existing living will. Another way to revoke an existing living will is to indicate verbally or in writing that the living will does not comply with the wishes of the person who executed it. It is important to note that verbal revocation is not valid unless it is supported in writing or by witnesses who are unrelated to the person who executed the living will. Finally, any previous living will is automatically revoked if a new living will has been executed. It is important to note that if any of the above methods are used to revoke or change a living will, the original document should be destroyed or marked as revoked or changed. It is helpful to review your living will on a regular basis to make sure that your wishes are up to date. If, after a review, changes are desired, please consult with an experienced estate planning attorney. Such an attorney can help ensure that all of your desired changes are properly executed and documented.
