What are the taxes on an estate?

In Georgia, the taxes on an estate are determined by the Georgia Department of Revenue. Generally speaking, there is no Georgia estate tax; however, there is an inheritance tax which is based on the size of the estate and the relationship of the recipient of the inheritance to the deceased. For example, a spouse or lineal descendant of the deceased, such as a child, is exempt from the tax, but someone who is a distant relative would pay a tax on the inheritance received from the deceased. The tax rate increases as the size of the estate and the relationship of the heir to the deceased decreases. The amount of taxation of the estate can also vary depending on the particular county in Georgia in which the estate is located. For example, some counties have adopted an estate tax to offset the costs of vital services, such as road improvements. In addition to taxes, the probate court may also impose other fees. It is always a good idea to consult with a probate or tax attorney if you are dealing with an estate in Georgia. An attorney can provide advice and guidance about the particular tax rates and fees that may be applicable to an estate.
