What is a workers' compensation hearing?
A workers’ compensation hearing is held to help determine if a worker should receive benefits for on-the-job injuries and illnesses. Hearings are conducted by the West Virginia Workers’ Compensation Board, or the Commissioner of Labor. During the hearing, both the employer and the injured employee present evidence and testimony to the Commissioner. The employee will present evidence and explain why they believe they should be compensated for their injury or illness. The employer will also give evidence to support their case. The employer may bring in witnesses to testify as to the circumstances of the injury or illness, as well as any medical records or reports that are relevant to the case. The Commissioner will oversee the hearing, ensuring that both sides are heard and that the evidence is fair and balanced. At the end of the hearing, the Commissioner will make a decision as to whether the injured employee should receive benefits or not. This decision is based on the evidence presented, as well as the applicable laws governing workers’ compensation in West Virginia. If the employee is found to be eligible for benefits, they will receive payment for medical expenses, lost wages, and other expenses related to their injury or illness.
