How do I appeal a workers' compensation decision?

If you’d like to appeal a workers’ compensation decision in Pennsylvania, you’ll need to file a Petition for Review with the Pennsylvania Workers’ Compensation Appeal Board. This can be done either online or via mail. You have the option to have a lawyer assist you with the process, but it’s not required. Once the Petition for Review is received and processed, the Appeal Board will send you a Notice of Hearing, which will specify a date and time for your hearing. The Notice of Hearing will also list any documents you should bring to the hearing. At the hearing, the Appeal Board will hear evidence and arguments from both sides (that is, you and the workers’ compensation insurer or employer). During the hearing you may be asked questions and the other party may present their arguments. After the hearing, the Appeal Board will review the evidence and arguments to make its decision. This decision will be sent to you in the form of a written opinion. If you are not satisfied with the decision, you may have the option to file an appeal with the Pennsylvania Commonwealth Court. It’s important to remember that the workers’ compensation appeals process in Pennsylvania can be complex, so it’s recommended that you work with a lawyer if you choose to pursue an appeal.
