What is a permanent disability?

Permanent disability is a legal term in Illinois Workers Compensation law that has a specific meaning. It is used to describe an injury or illness caused by the workplace that results in a lasting impact on a person’s ability to do their job. Generally, this means that the disability prevents someone from performing a job, or a job related activity, which they had been able to do before the injury or illness occurred. In Illinois, a disability can be classified as permanent when the person is both injured or made ill from the workplace and cannot return to their job. The disability must be expected to last for more than nine months or until the person reaches retirement age. It is possible for a disability to be determined as permanent after only a short amount of time, but the effects of the injury or illness must be expected to last a prolonged amount of time for the disability to be considered permanent. If a person is found to have a permanent disability from an illness or injury caused in the workplace, they are entitled to certain benefits through the Illinois Workers Compensation program. These benefits can include medical care, wage replacement, and other forms of compensation. These benefits can help employees with a permanent disability to maintain financial security.
