What is a permanent disability?

A permanent disability is an injury or illness that causes long-term or permanent harm to a worker’s body or mind. This can include physical injuries, such as the loss of a limb or a disability that affects a person’s ability to work; or mental or emotional impairments that prevent an injured worker from participating in regular and customary work activities. In Tennessee, the Workers’ Compensation Law requires employers to provide medical and disability payments to employees who are permanently disabled. The amount of compensation an injured worker receives for a permanent disability is based on the severity of the disability and the average weekly wage they earned at the time of the injury. In addition to medical benefits, a worker may receive weekly wage replacement benefits, vocational rehabilitation services, and help with training for new jobs. However, if the worker is unable to return to work, they may be eligible for Social Security disability benefits. Though a permanent disability can be challenging to deal with, the Workers’ Compensation Law in Tennessee is designed to ensure that injured workers receive the financial assistance they need to cope with their disability. They are also eligible for protection from workplace retaliation, so they can continue to receive the compensation and services they deserve.
