What happens if I'm not able to return to my pre-injury job?

If you are not able to return to your pre-injury job in West Virginia, you may be eligible for workers’ compensation benefits. These benefits may include wages for any lost income and the cost of medical treatments needed to help rehabilitate you. Your employer may be legally obligated to provide you with alternative work or retraining if you are unable to return to your pre-injury job. This means your employer is required to provide you with a job that is similar to the one you held before your injury, but within your physical abilities. If you decide not to accept the job, you may still be eligible for temporary disability benefits. To qualify for temporary disability benefits, the work must not be suitable and within your physical abilities. If you are not able to work and you have exhausted all retraining or alternative job opportunities, you may be eligible for permanent disability benefits. Permanent disability benefits may provide you with a lump-sum payment for the cost of medical treatments needed to help you, and/or a lifetime pension to help with lost wages. It’s important to consult an attorney that specializes in workers’ compensation law if you believe you are not able to return to your pre-injury job. This attorney will assess your situation, and make sure you are getting the compensation you are entitled to under West Virginia law.
