What is a residual disability?

Residual disability is a term used in Workers Compensation Law in Tennessee. It is a type of disability that occurs after an injury occurs and the worker has recovered from their injury, but still experiences a lasting effect. This effect can be physical, emotional, or a combination of both. For instance, an employee might suffer an injury to their arm in the workplace, which requires surgery to repair. After the surgery is successful, the employee recovers full use of the arm. However, they may have some residual disability, such as a slight lack of range of motion, or pain in the injury area when performing certain tasks. Residual disability is a type of disability that affects a person’s earning capacity. In Tennessee, if an employee has a residual disability that interferes with their ability to do their job, they can be eligible for workers’ compensation benefits. The benefits can include wage replacements, medical treatment, job retraining, and more. The amount of benefits and duration of time they are offered depends on the extent of the disability. Typically, a residual disability will be compensated up to the point where the employee can adjust to the impairment. The employee may also be eligible to receive additional compensation if the impairment prevents the employee from returning to their prior job or returning to work in general.
