Are punitive damages available in a wrongful death lawsuit?

In California, punitive damages may be available in a wrongful death lawsuit depending upon the circumstances surrounding the death. Punitive damages are given to punish a wrongdoer, so they are only applicable when the plaintiff can prove that the death was caused by gross negligence, reckless conduct, or malicious intent. Since these types of damages are only awarded if the plaintiff can prove an egregious level of wrongdoing, they are not routinely awarded in all wrongful death cases.
