Who is responsible for paying for the medical expenses of the deceased in a wrongful death case?

In Virginia, the individual or entity that is found liable for the death of the deceased will be responsible for paying for the medical expenses of the deceased in a wrongful death case. In some instances, this may be a single individual or a company that was negligent in their actions leading up to the individual’s death. In other cases, it could be a government agency that was responsible for inadequate safety protocols at the site. Regardless of who is found to be at fault, they will be held financially liable for the medical expenses of the deceased. This includes any medical expenses incurred while they were still alive, such as medical treatments, ambulance rides, hospital stays, and medical equipment purchased. In other cases, medical expenses may include payments for funeral and burial services, if applicable. In addition to the medical expenses, the individual or entity responsible for the wrongful death may also be liable for the payment of any remaining debt the deceased had at the time of their death. This includes credit card debt, mortgages, loans, and other forms of debt. Virginia laws also allow for compensation for loss of wages or income, as well as pain and suffering, loss of companionship, or other damages resulting from the wrongful death.
