What is the difference between wrongful termination and constructive dismissal?
The difference between wrongful termination and constructive dismissal is an important distinction to understand when it comes to employment law in Colorado. Wrongful termination refers to the illegal termination of an employee based upon certain protected class characteristics, such as race, gender, age, or disability. Constructive dismissal, on the other hand, is when an employer creates a hostile or unbearable work environment to the point where the employee feels they must resign in order to protect their rights. Wrongful termination in Colorado can be proven when there is a direct link between the termination and the employee’s protected class characteristics. The burden of proof lies with the terminated employee to prove discrimination or some other form of illegal motivation by the employer. Constructive dismissal is more difficult to prove because the burden of proof lies with the employee to prove that the work environment was so intolerable that they felt forced to resign. Constructive dismissal can also be proven if the employer offers the employee a significant change in job duties or working conditions but does not allow for a reasonable notice period for the employee to adjust to the new conditions. In other words, constructive dismissal occurs when the terms of the employee’s employment are significantly altered without adequate notice for the employee. It is important for employers in Colorado to understand the difference between wrongful termination and constructive dismissal in order to protect their business from potential lawsuits. Employees should also be aware of their rights and the difference between the two forms of dismissal in order to protect themselves should they face either of these unfortunate situations.
