What are the damages recoverable in a personal injury case?
In a personal injury case, damages are awarded to get a person back to where they were before the accident. In Hawaii, the damages recoverable in a personal injury case include but are not limited to physical and/or emotional pain and suffering, medical expenses, future medical expenses, lost wages, future lost wages, loss of consortium, punitive damages, and property damage. Physical and/or emotional pain and suffering are damages awarded to an individual for the physical and emotional trauma they endured as a result of the accident. Medical expenses are expenses incurred for medical care, including rehabilitation, therapy, medications, and other treatments. Future medical expenses are also available in a personal injury case and may include future surgery, treatment, or therapy related to the accident. Lost wages are wages that the injured person lost due to the accident, such as being unable to work or having to take a lower paying job while recovering from the injury. Future lost wages are wages that may be lost if an injured person is permanently disabled and unable to work in the same capacity as before the accident. Loss of consortium is a type of damage awarded to a spouse if the injured party is no longer able to provide the same level of companionship, love, and guidance to their partner. Punitive damages are damages awarded to punish the party at fault for their negligence or reckless behavior. Lastly, property damage is available to cover the costs of destroyed property related to the accident.
