The Duty of Care in a Negligence Claim in Arizona is a legal obligation to take reasonable steps to prevent others from being injured or suffering harm. Generally, it is an obligation to act in a way that a reasonably prudent person would act in similar circumstances. For example, a person who owns a car in Arizona must take reasonable care to make sure that the vehicle is in proper working order and that it is not a danger to other drivers on the road. A person who owns a building must take reasonable care to make sure that the building is in a safe condition. This Duty of Care applies to any person who owes a duty to another person to use reasonable care and to avoid causing harm. If someone fails to meet this Duty of Care, they can be found liable for Negligence if their actions result in harm to another person. Negligence is the failure to act with reasonable care, which leads to the injury of another person. To prove Negligence, the injured party must show that the defendant breached the Duty of Care owed to them and that the breach caused the injury in question. In addition to the Duty of Care, there are several other elements involved in a Negligence Claim. These include proving that the defendant owed the Duty in the first place, that the Duty was breached, that the breach caused the injury, and that the injury was foreseeable. Once all of these elements are established, the injured party can pursue compensation for any physical, emotional, and financial losses suffered as a result of the defendant’s negligence.
