What is the Duty of Care in a Negligence Claim?

The duty of care is an important concept in Oklahoma’s accident law. It outlines the expectations of how a responsible person should behave in order to avoid causing harm to others. In a negligence claim, the duty of care is the obligation of an individual to act with reasonable care and diligence. In order to prove negligence in an accident, the plaintiff must prove that the defendant breached the duty of care. The plaintiff must show that the defendant failed to act with the same level of care as a reasonable person would have. For example, an individual must obey traffic laws and use reasonable care when driving a motor vehicle. If that individual drives recklessly or ignores traffic laws and causes an accident, they may be held liable for breach of the duty of care. The duty of care will depend on the facts of each case. Generally, it is the responsibility of the defendant to make sure that no one is hurt because of their actions. Even if their actions do not directly cause harm, they may be held liable if their negligent behavior was foreseeable. For example, if a store owner fails to clean up a wet floor and someone slips and falls, the store owner may be liable. The duty of care is an important concept when considering a negligence claim in Oklahoma. It is the responsibility of the defendant to act with reasonable care and diligence in order to avoid causing harm to others. If it can be shown that the defendant breached the duty of care, they may be held liable for any resulting harm.
