What is a No-Fault Accident?
A no-fault accident is a type of accident in which the driver at fault is not held liable for damage to property, injury, or death caused by the accident. In California, if you are involved in an accident, the insurance company of each driver pays for their own insured driver’s damages, regardless of who caused the accident. In other words, one driver’s insurance company will cover their own driver’s property damage, medical bills, and any other expenses related to the accident, regardless of who was at fault. This type of accident is in contrast to a fault-based accident, in which the driver who caused the accident is held financially responsible for the damages and losses incurred by the other driver. In a no-fault accident, the at-fault driver is not responsible and can not be sued for damages. No-fault accidents are covered by a policy called “personal injury protection” or PIP. This coverage pays for lost wages, medical expenses, and other related expenses for the insured. If the costs are too high for a driver’s PIP coverage, the other driver’s insurance company may also be required to pay for some of the costs. This type of coverage is meant to provide financial relief to drivers who are involved in an accident, even if it wasn’t their fault.
