What is a release of liability?
A release of liability, also known as a waiver of liability, is a document that protects an individual or business from any legal responsibility should an accident occur. In Colorado, releases of liability are commonly used in situations involving activities that are inherently dangerous — such as sports or recreational activities — that have a higher risk for injury than the average activity. A release of liability typically states that the person or business signing the document will not be held responsible for any injuries or damages that may result from the activity. This means that any resulting medical bills, legal fees, or other related costs will be the responsibility of the individual or business engaging in the activity, regardless of fault. Generally speaking, an adult must give their informed consent before signing a release of liability. This means that the individual must be aware of all potential risks in order to use the document and can’t be coerced into signing it. Furthermore, certain releases of liability are not valid if a participant is under the age of 18. Releases of liability are not bulletproof — they can be challenged in court — but they do provide a certain level of protection for individuals and businesses operating in Colorado. It is important to understand how to use and structure a release of liability to ensure maximum protection.
