What is a civil case?

A civil case is a legal dispute between two or more parties. In North Carolina, civil cases are typically handled in the General Court of Justice, unless the case is specifically related to business, trade, or commerce. In these cases, the dispute must be heard before the North Carolina Business Court. In civil cases, the parties may be two individuals, two businesses, or a combination of both. The parties are not the government or the state, and the parties typically must bring their own lawyers. In North Carolina, civil cases can involve a wide range of legal issues, such as contracts, negligence, nuisance, or defamation. The primary purpose of a civil case is to resolve the dispute, usually by monetary payment from the person found at fault. In some cases, the dispute is resolved by a judge or jury, and in other cases, the case is settled out of court. The parties must agree to the settlement, and if they cannot agree, the case will proceed to court. In North Carolina, a civil case must be filed within three years of the date of the injury or event that gave rise to the dispute. To start a civil case, the plaintiff must file a complaint in the appropriate court and serve all the other parties in the case. The defendant must then respond to the complaint. If the defendant fails to respond, the plaintiff can request a default judgment.
