What types of damages are available in a personal injury claim?

In Texas, when you have been injured due to someone else’s negligence, you can seek damages through a personal injury claim. The purpose of damages is to compensate you for the losses and suffering you have experienced due to the accident. Generally, there are two types of damages that can be awarded in a personal injury claim in Texas. These include compensatory damages and punitive damages. Compensatory damages are the most common type of damages awarded in a personal injury lawsuit. These damages are meant to compensate you for any medical expenses, lost wages, emotional distress, and pain and suffering you have experienced due to the accident. They are meant to make you “whole” again, or put you back in the position you would have been in if the accident had not happened. Punitive damages are much less common and are typically only awarded in cases where the defendant’s conduct was especially egregious. These damages are meant to punish the defendant and deter others from engaging in similar conduct. Punitive damages are generally capped in Texas and may not exceed two times the amount of compensatory damages. In any personal injury case, it is important to speak to a qualified injury lawyer to understand what types of damages you are eligible for. Depending on the situation, you may be entitled to compensation for both economic and non-economic losses.
