What is an alternative dispute resolution?
Alternative dispute resolution (ADR) is a way to resolve a dispute without going to court. In Arizona, ADR is an alternative to traditional litigation that may involve negotiation, mediation, arbitration or other forms of dispute resolution. ADR can be used in a variety of cases, including civil disputes, marital disputes, labor and employment disputes, and family law disputes. The advantages of an alternative dispute resolution are that it can often be less expensive, more confidential and faster than a traditional courtroom setting. The process is also flexible, allowing the parties to choose which specific ADR process works best for their particular dispute. Unlike the court system, ADR is also less rigid and allows for a more collaborative process between the parties. ADR is often voluntary. Arizona’s court system promotes the use of ADR and will sometimes require parties to undergo mediation before they can have their case heard by a judge. ADR can be conducted by someone who is neutral and impartial, a trained mediator or an arbitrator who has been appointed to make a binding decision. In Arizona, many attorneys are trained in and offer ADR services.
