What is a toxic tort?

A toxic tort is a type of legal claim that involves harm caused by exposure to a hazardous substance or agent. These claims can arise from activities such as manufacturing, disposal, storage, or transport of a toxic substance. In the state of Oklahoma, anyone who has been injured as a result of exposure to a toxic agent has the right to seek compensation for their injuries through a tort action. In a tort action for a toxic tort claim, the injured individual must prove that the hazardous substance was unreasonably placed in an environment which lead to their injury. The plaintiff must also show that they were exposed to the dangerous substance as a result of the defendant’s negligence. The plaintiff must also prove that they suffered actual damages as a result of the exposure. In Oklahoma, toxic tort cases are typically brought as personal injury claims. Damages that may be recovered for a toxic tort claim may include medical expenses, lost wages, and pain and suffering. If the defendant’s actions were especially egregious, punitive damages may even be awarded. It is important to note, however, that determining the cause of the plaintiff’s injury in a toxic tort case can be a difficult process. As a result, it is highly recommended that anyone considering bringing a toxic tort claim in Oklahoma seek the services of an experienced attorney.
