What is gross negligence?

Gross negligence is a form of negligence that is much more serious than ordinary negligence. In North Carolina, it is a legal concept that holds individuals to an even higher standard of care when their actions risk causing harm to others. It requires a person to have a conscious disregard for the safety of another person or for their rights. Examples of gross negligence vary but generally include ignoring safety measures, failing to follow instructions, ignoring warnings, or failing to act in an appropriate manner given the situation. Gross negligence is usually more serious and can result in greater damages or liability for the negligent party than would be the case with ordinary negligence. When it comes to accidents, gross negligence can occur when a person acts with conscious disregard for their own safety or for the safety of other people. For example, a driver who speeds recklessly through a red light or fails to keep their car in proper working order may be considered to have acted with gross negligence. Gross negligence can also refer to a person’s failure to lend assistance during an emergency, or their intentional disregard for the rights of another person. In North Carolina, those who act with gross negligence may be held liable for any harm or damages their actions cause.
