What is a wrongful termination claim?

A wrongful termination claim is a legal action taken when an employee claims they were unlawfully fired. This can happen when an employee is fired due to discrimination, violation of an employment agreement, retaliation for reporting a violation, or a violation of public policy. In Arizona, wrongful termination claims are governed by the Arizona Revised Statutes. Under Arizona law, an employer may not terminate an employee for any of the following reasons: race, religion, sex, age, national origin, disability, or genetic identity. An employer also may not terminate an employee in retaliation for reporting a violation of the law or protected activity, such as filing a complaint with the Equal Employment Opportunity Commission. Additionally, an employer may not terminate an employee for exercising their rights under an employment agreement, such as taking a certain amount of paid time off or filing a workers’ compensation claim. An employer also may not terminate an employee for performing a duty assigned to them by a law or regulation, or exercising a right provided by a public policy. If an employee believes they have been wrongly terminated, they may file a wrongful termination claim in Arizona by filing suit in the appropriate court. When filing a claim, an employee will need to provide evidence that their termination was illegal due to a violation of Arizona law. It is important to note that Arizona employers are not required to give an employee a reason for their termination.
