What is a wrongful termination claim?
A wrongful termination claim is a legal claim that someone was fired from their job for unfair reasons. In Minnesota, wrongful termination claims are often made when an employer fires an employee for reasons that the employee feels are discriminatory, retaliatory, or otherwise wrongful. Under Minnesota state law, employers cannot terminate employees for any of the following reasons: their race, their religious beliefs, their age, their gender, their sexual orientation, or any other protected group status. Employers are also prohibited from firing an employee in retaliation for making a claim against their employer, such as filing a workers’ compensation claim or filing a complaint with the Equal Employment Opportunity Commission (EEOC). If an individual feels that they have been wrongfully terminated, they have the right to file a wrongful termination claim against the employer. In the claim, the individual must provide evidence to support their claim, such as records of discrimination or retaliation. If the claim is successful, the employee can be entitled to financial compensation, such as back pay, future earnings, and emotional distress compensation. It is important to note that, in Minnesota, there is a statute of limitations for filing wrongful termination claims. This means that the claim must be filed within a certain timeframe from the date of termination or the employee may be unable to bring their case to court. It is important to act quickly if an individual believes that they have been wrongfully terminated.
