How is maritime jurisdiction determined under Admiralty Law?

Under Admiralty Law, maritime jurisdiction is determined by looking at the nature of the dispute, as well as the location of where the dispute occurred. Within North Carolina, there are four full-time Admiralty Judges that preside over any case that falls under maritime jurisdiction. If the dispute is based in contractual matters, or involves goods or services related to a vessel, then it falls into the realm of Admiralty Law. If the dispute occurs on navigable waters, or involves a vessel on navigable waters, then it also falls under Admiralty Law. Additionally, Admiralty Law applies to any works associated with a vessel, such as docks, wharves, or any other related infrastructure installed on navigable waters. In North Carolina, the court in charge of determining maritime jurisdiction is the North Carolina Business Court. This court handles all admiralty related cases that occur not only in North Carolina, but any disputes that occur within United States waters as well. This court hears all preliminary facts about the case and then determines if the dispute falls under the jurisdiction of admiralty law. If so, then the court decides to either hear the case itself or forward it to the full-time Admiralty Judge. Either way, the court must decide if the dispute is maritime in nature, and therefore falls under Admiralty Law.
