What is the Admiralty Law relating to marine salvage?

Admiralty law, or maritime law, relates to the rights and responsibilities of those involved in the maritime industry, including marine salvage. In Kansas, the Kansas Coastal Management Program defines marine salvage as the “raising, removal, destruction, or other disposition of a vessel, craft, or other waterborne property in the navigable tidal waters of the state, or the salvaging of cargo, freight, or other personal property of value, or the services rendered in the saving of lives, or of any other actual or potential benefit to the navigable waters of the state”. Under Kansas law, the owner of any property involved in a salvage operation must pay the salvors for the services rendered in saving the property. This includes any fees or expenses associated with the salvage operation as well as compensation for wages or other costs. In addition, the salvors may be entitled to a portion of the value of the property saved, or to a salvage award. The award is determined by the court and is based on several factors, such as the degree of danger, the skill and effort of the salvors, and the value of the property saved. The Kansas statute further specifies that any dispute over the salvage award must be resolved through a court action. Otherwise, the salvors are entitled to the award as determined by the court. Ultimately, if a dispute over a salvage award arises, the court will decide who is entitled to the award and the amount of compensation to be paid.
