What is the Administrative Procedure Act?
The Administrative Procedure Act (APA) is a federal law that governs how the administrative branches of the federal government are allowed to create and enforce their rules. It sets the standards for how agencies must disclose their proposed rules and regulations to the public, how the public can comment on those proposals, and how agencies must respond to the comments. It also requires agencies to provide interested parties with the opportunity for a hearing and judicial review of their decisions. The goal of the APA is to ensure that the government follows certain procedures when creating and enforcing its regulations to provide fairness and transparency to all parties involved. In Washington State, the APA applies to all state and local agencies, and allows for citizens to challenge those agencies’ rules if they feel they are unjust or unconstitutional.
