What is the role of the Administrative Law Judge in an administrative proceeding?

The role of the Administrative Law Judge (ALJ) in an administrative proceeding is to serve as an independent, impartial, and objective fact-finder. An ALJ is appointed by the agency that initiated the administrative proceeding. Typically, it is the agency’s responsibility to fill the position for their hearings. In Florida, Administrative Law Judges are employed by the Division of Administrative Hearings (DOAH). The primary role of the ALJ is to preside over the hearing and to make sure it is conducted properly and in compliance with the applicable laws and regulations. The ALJ will determine who may participate in the hearing, will review and consider the relevant evidence that is presented, will take testimony from witnesses, and will ultimately make a recommendation to the presiding agency. An ALJ also serves to protect the due process rights of the parties involved, and to ensure fairness throughout the entire process. They are responsible for encouraging settlement agreements between parties, and for developing and identifying the relevant issues for consideration by the agency. In short, an ALJ provides an unbiased third-party review of the facts of the case and makes a recommendation based on their review. The goal of the ALJ is to ensure that the proceedings are conducted properly and that all of the facts and evidence are properly considered. Ultimately, the ALJ serves as a bridge between the agency and the parties involved in the administrative proceeding.
