What is a step-parent adoption?

A step-parent adoption is a type of adoption that occurs when a stepparent wishes to legally adopt their spouse’s child. In a step-parent adoption, the stepparent assumes all the parental rights of the noncustodial natural parent. In Florida, this type of adoption can take place if the natural parent voluntarily relinquishes their rights, or if there is a court order involuntarily terminating the parent’s rights. The process for a step-parent adoption in Florida typically involves both parents appearing in court. Once the adoption process is started, a home study or other investigation may be requested by the court to ensure the well being of the child is kept in mind. During the hearing, the court will decide if it is in the best interest of the child to be adopted by the stepparent. If approved, the parent will be legally responsible for the child just as if the child was born to them. In Florida, it is important to note that only married couples are permitted to adopt through this process. If the parents are not married, the stepparent must complete the adoption process as any other individual would. A successful step-parent adoption in the state of Florida grants all the same rights and responsibilities of a traditional adoption, including the child legally taking the last name of the adoptive parent.
