The cost of using a collaborative law process depends on a variety of factors and will vary depending on the details of the dispute and the attorneys involved. Generally, larger disputes and those which involve specialists in various fields such as financial advisors, mental health professionals, or forensic accountants may require more complex negotiations and more attorney time, thus resulting in a higher cost. However, even in these cases, the cost of collaborative law is usually lower than that of a traditional courtroom trial. Costs can also depend on the lawyers and their fees. Some lawyers who specialize in alternative dispute resolution charge on an hourly basis, while others work on a flat fee arrangement. Additionally, if a collaborative divorce lawyer will represent both spouses, that can reduce fees for each spouse. In Washington, the Collaborative Family Law Act, initiated in 2002, dictates that each spouse pays half of the co-attorneys’ fees, or the whole fee if there is only one attorney. The fees are measured by the amount of work needed and range from $1,000 to $250,000. Ultimately, the cost of collaborative law can be significantly less than that of a trial and is decided on a case by case basis. Some processes are able to be completed in as little as one or two meetings, which keeps the total cost of the process low.
