What are the guidelines for Green Advertising?

Green advertising, or greenwashing, is when a company creates an advertisement that makes it appear as though their product or service is more environmentally friendly than it actually is. In Texas, there are guidelines in place for green advertising to ensure that businesses are not making false or misleading claims about the environmental friendliness of their products or services. The Texas Deceptive Trade Practices–Consumer Protection Act (DTPA) requires that claims made in green advertising must be truthful and not misleading to the consumer. This means that companies should not make claims that are exaggerated or not completely accurate. Additionally, they should not use images, symbols, or language that could mislead the consumer. The Federal Trade Commission (FTC) also has a Green Guides document that businesses must abide by. This document outlines specific areas in which companies should be especially cautious when making green claims. These areas include claims about compostability, recycled content, renewable energy, non-toxic or less-toxic ingredients, and naturally derived ingredients. Finally, companies should have a reasonable basis for any green claims they make. This means that they should have valid evidence to back up their claims. Businesses should keep track of any research, studies, or tests that support their claims so that they can easily provide evidence if they are ever asked. When advertising a product or service as environmentally friendly, it is important for businesses to comply with all applicable green advertising regulations in order to protect both their customers and their reputation.
