What are the prohibitions for product placement?

Product placement in Florida is regulated by the Federal Trade Commission’s (FTC) Endorsement Guide and state and local laws. In Florida, product placement must be disclosed and cannot be false or deceptive. Generally, product placement is not allowed when targeting minors. It must be apparent to the public that the placement was paid for. If a product is placed in a television program or movie, it must be clearly marked with a disclosure statement. Product placement must also not be misleading or imply a relationship between the product and the show or movie. Companies must pay for the placement or provide the product or service free of charge in exchange for promotion. In addition, the placement of the product must be appropriate for the show or movie. For example, if a product is placed in a family movie, it cannot be for a product that is not suitable for children. Further, no paid product placement can be placed in programs or movies about health, alcohol, tobacco, or diet. Finally, the placement of a product should not be used to mislead viewers. For example, placing a product in a scene that implies it has special action capabilities or that it is endorsed by the show when it is not.
