What rules govern advertising of alcoholic beverages?
In Pennsylvania, there are specific regulations that must be followed when advertising alcoholic beverages. These regulations are set by the Pennsylvania Liquor Control Board (PLCB). According to these rules, any advertisement of alcoholic beverages must include the following warning: “Underage Drinking is Illegal”. In addition, advertisements must not target individuals under the age of 21 and must not be placed in an environment where the majority of people present are under the legal age. Any advertising targeted to underage individuals may result in criminal prosecution. In addition, advertisements for alcoholic beverages are not allowed on radio, television, or in any other form of public communication. Additionally, any advertisement must not make claims that suggest drinking alcohol will increase physical performance or decrease stress. Lastly, when advertising any alcoholic beverage, the actual product should be visible in the advertisement and should not be associated with violence or encourage irresponsible drinking. All advertisements should include information about the alcoholic content of the alcoholic beverage and the local authority or contact information for the PLCB. It is important to note that failure to adhere to these rules may result in serious consequences, including criminal prosecution. Therefore, it is necessary for all Pennsylvania businesses to adhere to the rules and regulations that govern the advertising of alcoholic beverages.
