What rules govern advertising of alcoholic beverages?

In Texas, advertising of alcoholic beverages is subject to a few rules found in the Texas Alcoholic Beverage Code. Businesses that sell and serve alcohol, such as restaurants and bars, are prohibited from advertising alcoholic beverages in a manner that is considered “false or misleading”. This means that businesses cannot advertise alcoholic beverages as being healthy, therapeutic, or containing certain flavors or ingredients that are not actually in the product. Additionally, businesses cannot advertise the sale of alcohol in a way that is intended to appeal to minors, such as cartoon images or phrases like “Happy Hour”. Finally, businesses are not allowed to offer alcoholic beverages on a free or discounted basis. Alcoholic beverage advertisements must also include the phrase “Drink Responsibly”, and the message must be displayed in letters no less than 1/4 inch in height. The letters must be in bold-faced type and in a contrasting color to the rest of the advertisement. Additionally, any advertiser must make sure that there is not excessive or improper use of display or printed material in order to attract minors to purchase or consume alcohol. Any advertising for alcohol must be done in a manner that is respectful and should not be offensive or potentially harmful to minors.
