What is “copyright trolling” and what laws apply to it?

Copyright trolling is a term used to describe the practice of a copyright holder in Delaware, or someone granted a copyright from the copyright holder, aggressively enforcing their rights to a copyrighted material. This involves threatening legal action against individuals who are accused of infringing on their copyright or issuing cease and desist letters. Copyright trolling can take many forms, such as sending demand letters for compensation, threatening to sue or take criminal action against the accused, or even filing a lawsuit without specific evidence of infringement. In Delaware, the law requires that any copyrighted material must be protected by proper copyright law and also requires that any disputes be settled in court. This includes copyright trolling, which means that copyright holders must prove that an infringement occurred. They may be able to recover damages for the amount of harm they suffered due to the illegal use of their copyrighted material. Another important law is the Digital Millennium Copyright Act (DMCA).
