What are the laws pertaining to genetically modified organisms (GMOs)?
In Texas, laws pertaining to genetically modified organisms (GMOs) are regulated by state law and the Texas Department of Agriculture (TDA). According to Texas Administrative Code, § 18.89, the TDA oversees the development, sale, use, and labeling of agricultural products whose genetic makeup has been modified. The TDA requires that all genetically modified organisms (GMOs) be evaluated to ensure that they are safe for human consumption and have minimal impact on the environment. To this end, a product must be inspected and tested to determine the presence of any possible toxins, allergens, or other substances that could be harmful. Additionally, the product must undergo a review to determine if its genetic modifications have a potential to affect the environment or agricultural practices. These reviews must be conducted in accordance with the standards set by the TDA. Additionally, the TDA requires that any labeling of agricultural products that contain GMOs must prominently feature the phrase “genetically modified” or a symbol that clearly denotes the presence of GMOs. The labeling must make it clear to consumers the intentional presence of a genetically modified organism (GMO) in the product, if applicable. It is important for all Texans to understand the laws governing the use and labeling of GMOs. This information helps to ensure that Texans understand the potential risks and impacts of consuming or using products with genetically modified ingredients.
