What are the water rights laws in agriculture?
Water rights laws in Washington regulate how much water can be used for agricultural purposes and how it is shared amongst farmers. These laws are based on the principle of water quantity and quality management. In Washington, agricultural water rights are established by obtaining a permit from the Department of Ecology. The law requires an applicant to submit an application that includes information about the water right, the source of water, the amount of water to be used and the purpose of the water use. These laws also dictate that the water being used must not cause harm to other water users or the environment. In addition, any water used for agricultural purposes must be put to beneficial use, meaning that it is used in a manner that helps the environment such as by providing groundwater recharge. The law also states that water rights are based on a first-come, first-served basis. This means that the first person who applies for a water rights permit has the first claim to the water and the later applicants are only granted rights if there is enough water left for them. Furthermore, water rights can also be sold, leased, or exchanged. Any exchange or transfer of water rights must meet certain criteria and be approved by the local state or county, depending on where the water is located. Overall, Washington’s water rights laws are designed to ensure that enough water is available to meet agricultural needs while also protecting the environment. Through these laws, the state is making sure that all Washington farmers have access to the water they need.
