What is the Packers and Stockyards Act?

The Packers and Stockyards Act is a federal law that protects farmers, ranchers, and other agricultural producers in Texas from unfair, deceptive, and fraudulent practices in the marketing of livestock, poultry, and other agricultural products. The Act, which was enacted in 1921, prohibits unfair or deceptive practices in the marketing and buying of livestock, poultry, and other agricultural products. The Act also provides legal protection to those who market or purchase such products. Specifically, the Act prohibits several different kinds of unfair practices, such as buying or selling livestock without full disclosure of terms and conditions, or deliberately misstating the condition of purchased or sold livestock. The Act also prohibits certain practices, such as “kickbacks” or “bribery” of buyers or sellers, and it gives the Secretary of Agriculture authority to issue regulations and take enforcement actions against those who violate the Act. The Act also establishes the Packers and Stockyards Administration, which is an agency within the U.S. Department of Agriculture responsible for administering and enforcing the Act. The agency is responsible for investigating suspected violations of the Act, as well as taking steps to ensure compliance with the law. When the agency finds violations of the Act, it can issue orders requiring violators to stop their offending practices. Such orders can also result in the imposition of fines, and in certain cases, the suspension or revocation of certain business licenses.
