What are the laws regarding agricultural workers’ rights?
In Pennsylvania, agricultural workers have certain rights that are protected by law. The Pennsylvania Department of Labor and Industry (DLI) is responsible for enforcing labor laws that protect agricultural workers from discrimination, wages and overtime pay. The Pennsylvania Human Relations Act prohibits employers from discriminating against agricultural workers on the basis of race, color, religion, ancestry, age, sex, national origin, and disability. The law also provides agricultural workers with the right to file a discrimination complaint with the DLI, if they feel they have been subject to discrimination. The Pennsylvania Minimum Wage Act ensures that agricultural workers receive a legal minimum wage for their labor. This law provides agricultural workers with the right to receive at least the state minimum wage for all work performed, which is currently set at $7.25 per hour (in 2021). In addition, agricultural workers are entitled to overtime pay of 1.5 times their regular hourly wage after 40 hours in a single workweek. The Occupational and Safety Health Administration (OSHA) also requires employers to provide safe and healthy working conditions for their agricultural workers. This means providing workers with the right to access safe equipment and protective gear, as well as the right to refuse to work in dangerous conditions. Overall, Pennsylvania law provides agricultural workers with basic rights that protect them from discrimination, unfair wages, and dangerous working conditions. It is important for agricultural workers to be aware of their rights, so they can ensure that their rights are being respected.
