What are the laws regarding agricultural workers’ rights?
In the state of Texas, agricultural workers have rights which are protected by law. The Texas Law of Agricultural Labor Relations provides that agricultural workers have the right to organize or associate, to bargain collectively, and to participate in strikes and boycotts. Additionally, agricultural workers in Texas are afforded the right to receive a minimum wage, to be paid for overtime work at a rate of one and a half times the regular wage, to take rest periods and meal breaks, and to have reasonable access to restrooms and drinking water. Agricultural workers in Texas are also protected from unfair treatment. This includes the right to be free from discrimination in hiring, wages, working hours, and other terms and conditions of employment based on race, color, national origin, religion, sex, age, or disability. Furthermore, employers are prohibited from retaliating against agricultural workers for filing complaints related to discrimination or wages, for testifying in proceedings related to such complaints, or for engaging in other protected activities. Finally, agricultural workers in Texas have the right to a safe and healthy workplace. Employees must be provided with adequate protection from hazardous materials, and employers must provide safety training and supplies to protect against occupational diseases and illnesses. To ensure that these laws are followed, the Texas Department of Licensing and Regulation oversees enforcement of the Texas Law of Agricultural Labor Regulations.
