What are the laws governing the use and disposal of agricultural waste?
In West Virginia, the laws governing the use and disposal of agricultural waste are set out in Article 6 of the West Virginia Water Pollution Control Act. This section of the law sets out the requirements for proper disposal of animal and other agricultural wastes in order to protect water quality. For most agricultural activities, farmers must obtain a permit from the West Virginia Department of Environmental Protection (DEP) to discharge any waste into waterways. In addition, the DEP has put in place criteria for the proper use and disposal of waste such as manure, compost, and other organic wastes. These criteria include best management practices for storing and handling waste, the proper application of fertilizers, pest control products, and other waste products. To ensure that agricultural waste materials are properly managed, the DEP has set forth guidelines for proper disposal. These guidelines include the proper storage and handling of agricultural waste materials, proper site selection for waste disposal sites, restrictions on the use of certain chemicals, and best management practices for nutrient management. In addition to regulatory guidelines, the West Virginia Department of Agriculture has an educational program to help farmers and other agricultural producers understand and comply with the laws governing the use and disposal of waste materials. This program provides training and resources to help producers understand the regulations and take steps to protect water quality from agricultural waste.
