What are the laws governing the sale of products labeled as “organic”?

In North Carolina, organic products must meet certain requirements in order to be labeled as such. The North Carolina Department of Agriculture & Consumer Services enforces the National Organic Program regulations. Under these regulations, organic products must be produced without using synthetic fertilizers, sewage sludge, or genetically modified organisms. Additionally, they must be produced and processed on farms that have been inspected and certified by the USDA. The law requires that organic products must be labeled with the USDA logo and the phrase “Certified Organic” or “USDA Organic”. Organic products must also list the name and address of the certifying agent. Organic producers must also keep records of the production, handling, and sale of their products. These records must include the type, quantity, and source of all inputs used, as well as information on sales and other transactions related to the organic product. Organic retailers must display organic labels on their products. Additionally, all organic products must be separated from non-organic products during handling and processing to avoid cross-contamination. Organic producers and retailers must comply with these laws or face penalties. Penalties can include fines, revocation of organic certification, or other disciplinary action. Producers must also keep records of their organic products to prove that they are compliant.
