What are the laws concerning the use of chemicals in food production?
In Delaware, the use of chemicals in food production is regulated by the Delaware General Assembly. The provisions are outlined in Title 3 (Agriculture) of the Delaware Code. The Delaware General Assembly prohibits the use of any chemical, pesticide, fertilizer, or other agricultural product that is not approved by the Delaware Department of Agriculture or the Environmental Protection Agency (EPA). Farmers and other producers can only use chemicals, pesticides, fertilizers, or other agricultural products if they are registered with the Delaware Department of Agriculture. The Delaware General Assembly also prohibits the use of any pesticide, fertilizer, or other agricultural product that is not registered with the Delaware Department of Agriculture and approved for use in the production of food. Any chemical, pesticide, fertilizer, or other agricultural product that is used must meet all applicable labeling requirements. Additionally, the Delaware General Assembly requires producers to follow the instructions on the product label regarding the application of any chemical, pesticide, fertilizer, or other agricultural product. Producers must also abide by all applicable laws, rules, and regulations related to the use of chemical, pesticide, fertilizer, or other agricultural products in the production of food. Finally, the Delaware General Assembly requires producers to use a chemical, pesticide, fertilizer, or other agricultural product in a manner that will not cause any harm or injury to humans, animals, or the environment. Violating the provisions of the Delaware General Assembly related to the use of chemicals in food production is a criminal offense and can result in civil and criminal penalties.
