What are the laws concerning the use of chemicals in food production?

In North Carolina, the use of chemicals in food production is regulated by the state’s Pesticide Law, found in Title 143B of the North Carolina General Statutes. This statute requires that all pesticides be registered with the North Carolina Department of Agriculture and Consumer Services (NCDACS), and establishes licensing and certification qualifications for those who apply these chemicals. Under this law, each pesticide must be labeled with the name of the active ingredient, the amount per unit of measure, the directions for use, the precautions to be taken, and the EPA registration number. Pesticide labels must also include a list of plants on which the pesticide can be used, as well as the crops, animals, and other things on which the pesticide must not be used. Before applying pesticides, license holders must check the product label to ensure that it is legal to use on the intended crop or other target. Additionally, all applicators must follow Safety Data Sheet (SDS) instructions to ensure their safety and the safety of others. Pesticides must be kept in a secure location away from children, pets, and other people when not in use. Finally, the state has established a “Right to Know” law which requires that information regarding the use of pesticides be provided to the public upon request. This includes information on the types of chemicals used, the amount applied to each field or area, and the date the pesticide was applied.
