What are the laws governing the use of biodegradable plastic in agriculture?
In Delaware, as in many states, there are laws in place to regulate the use of biodegradable plastic in agriculture. Biodegradable plastic refers to plastics that will break down over time and return to the environment, rather than remain in the environment for hundreds of years like traditional plastic. The Delaware Department of Agriculture (DDA) requires farmers who want to use biodegradable plastic in agriculture to obtain a certification from the DDA. This certification will ensure that the farmer is using the biodegradable plastic correctly and safely. In addition, the DDA also requires that the farmer be able to demonstrate that the use of the biodegradable plastic does not pose a threat to the environment. Furthermore, the DDA requires that all biodegradable plastic products used in agriculture must be labeled as such. It is illegal to sell or distribute any biodegradable plastic product that is not properly labeled. Such labels must also include information regarding the specific materials used to produce the plastic. Finally, it is important to note that it is illegal to use biodegradable plastics in any way that could harm the environment. This includes improper disposal, such as improper burning or dumping. As such, farmers must be sure to properly and safely dispose of biodegradable plastic wastes in accordance with regulations set forth by the DDA.
