What laws apply to aircraft registration and ownership?
In Louisiana, aircraft owners are subject to the Federal Aviation Regulations (FARs) and Louisiana state laws and regulations regarding aircraft registration and ownership. Commonly referred to as the “Louisiana Aeronautical Code,” the state’s aircraft laws are part of the Louisiana Revised Statutes, which are available online. Under the Louisiana Aeronautical Code, all aircraft operating in the state must have a valid FAA certificate of registration. Aircraft owners must keep proof of registration on board the aircraft at all times and must display the certificate in a visible place within the cabin upon request. All aircraft must also be maintained in accordance with FARs and Louisiana regulations. Before purchasing an aircraft, buyers should make sure that all applicable state and federal registration requirements have been met. Only the registered owner of an aircraft can legally buy, sell, or transfer ownership. All transfers of aircraft ownership must be completed and notarized in the presence of two witnesses. Additionally, in Louisiana all aircraft owners must pay a property tax on their aircraft as well as an annual registration fee. By familiarizing themselves with the FAA regulations, Louisiana Aeronautical Code, and local registration requirements, aircraft owners can ensure that their aircraft is properly registered and operated in accordance with all applicable laws.
